自民、公明両党は７日、インターネットを通じた音楽や映像ファイルの違法ダウンロードに対し、２年以下の懲役か２００万円以下の罰金を科す法案をまとめた。民主党に協力を求め、来年の通常国会で成立を目指す。　ネット上では音楽ファイルなどの違法ダウンロードが相次ぎ、関係業界に多大な損害を与えている。
従来、違法なアップロードは著作権法で処罰対象とされていたが、ダウンロードには刑事罰が科されていなかった。
